- COMMERCIAL VS PERSONAL USAGE -

 

 
 
  • All images purchased from ADB Imagery include a Personal Usage LIcense as standard.

    "Personal Use" covers usage on personal profile sites such as social media, iPhone/Laptop/Tablet wallpaper or printed for personal use. This license does not permit clubs, brands, organisations, artists or businesses to use an image for commercial/marketing/advertising purposes, or any other purpose that may result in financial gain to the client.

  • A commercial license is required for any form of commercial/advertising/marketing use either for profit or non-profit. This includes, for example, promotional material for events, magazines or a businesses social media/wesbite.

    Commercial licenses include 12 months of usage after which the client may choose to renew the license for another 12-month term.
    Shorter or longer-term licenses are available upon request.

    ADB Imagery offers 3 separate commercial licenses to better suit your marketing needs. Clients may purchase the required license separately or a combination of all 3.

    Digital - Images may be used for advertising on all digital platforms.
    Print - Images may be used in print media for advertising, this includes, but is not limited to, event posters, banners, pamphlets etc
    Merchandise - Images may be used for digital or printed merchandise that is intended for resale/financial profit. This includes, but is not limited to, t-shirts, posters, tote bags etc

    Unauthorised use of an image will incur the full payment plus a 20% fee.

  • ADB Imagery owns the copyright to all images and artworks created.
    By default, all purchased images include a Personal Usage License. Clients may purchase a Commercial Usage License to use the images for advertising purposes.

    Clients also have the option to request full copyright transfer for an additional fee. Please contact ADB Imagery for more information.

    Copyright is a form of Intellectual Property Law and gives copyright owners exclusive rights to deal with their works in certain ways.

    In Australia, copyright law is set out in federal legislation (Copyright Act 1968) and in court decisions that have interpreted the Act. As copyright law is federal legislation, liability for infringement is strict; good intentions and misinformation are not valid defences if you are caught infringing copyright.

  • When a client purchases an image they are paying for the time, creative skill and services rendered to create that image.
    If a client wishes to gain financial profit from the images created then a commercial license is required.
    It is not just important for you to have permission from the copyright owners and pay for the right to reuse content for the benefit of your business; it is a legal requirement too.

  • Commercial licenses start from AUD$150, however, licensing is generally priced specifically for each project/client.
    There are a number of factors that determine the cost of a commercial license.
    Some of these include:
    - Media type (digital or print)
    - Duration (12 months)
    - Location (Australia only or worldwide)

    Other factors may include audience reach and the size of the business purchasing the license.
    For example, a local hair salon will not be charged the same licensing fee as an internationally recognised business.

  • Most professional commercial photographers will charge a licensing fee for commercial use of their images. If they don’t - be cautious.

  • Any commercial image license that you purchase will include a digital certificate stating the license information and a digital contract; both signed by ADB Imagery.
